1. The “Jelimals Space Runner Contest” (the “Contest”) is organised by ITC Limited (“ITC”). 2. Consumers participating or seeking to participate in the Contest shall individually be referred to as “Participant” and collectively as “Participants”. 3. If you are a Participant below the age of 18 years, your parent(s)/legal guardian hereby provide consent on your behalf to enter into the Contest and to stand a chance to win prizes as per the terms & conditions set forth herein. Failure to provide such consent will result in disqualification from this Contest. 4. Participation in this Contest is purely voluntary. By participating in this Contest, each Participant is deemed to have accepted the complete terms and conditions of this Contest available on www.jelimals.in/t&c (“Contest Website”) as well as the decisions of ITC, which are final and binding in all matters related to the Contest. Successfully entering the Contest and winning a prize is subject to all requirements set forth herein. 5. ITC reserves right to terminate, modify or extend this Contest, at its absolute discretion, without assigning any reason whatsoever including extending, withdrawing, or discontinuing the same without notice, at its sole and absolute discretion and without any liability. All decisions of ITC in respect of the Contest and the prizes therein will be final and binding. 6. The Contest shall be live from 12:00 hours on 1st Febraury, 2024 to 31 st March 2024(“Contest Period”). 7. The Contest is subject to all applicable central, state and local laws and regulations. 8. The Contest shall be run on the Jelimals Rs. 10 and Rs. 5 packages. (“Promotional Pack(s)”). The Contest is a limited period offer valid on select stocks of Jelimals. Jelimals packages without this offer are also available in the market. 9. Purchase of the Promotional Pack is not required to participate in this Contest. ELIGIBILITY 10. Only Indian citizens residing in India are eligible to participate in this Contest. Participants below the age of 18 years can participate only with the consent of their parent(s)/legal guardian. 11. In order to be eligible for the prize, all Participants will be required to have valid address proof, government issued photo identity proof such as PAN Card/ Driver’s license/Voter ID/valid passport etc, or parent(s)/legal guardian’s consent, if applicable a copy of which will have to be submitted at the request of ITC, without which the Participant will be disqualified from the Contest. 12. ITC reserves the right to exclude any person from the Contest on the grounds of: (i) misconduct or criminal record; (ii) tampering with the Entry process or the operation of Contest; (iii) acting in violation of these terms and conditions; (iv) acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten or harass any other person; or (v) for any other reasons, as it may deem fit and proper. Participants can play the Game online and stand a chance to win prize(s) depending on the milestones achieved after playing the Game. d) The Game is comprised of 6 individual planetssections namely - Moon’s Bloom, Moon’s Bloom Fury, Space Runner, Space Runner Rogue, Claytron and Claytron Ablaze. Each planet of the Game consists of 3 milestones. Each planet of the Game can be played through two links as explained in clause 13(f) below. e) Each planet of the Game would be in the format of an endless runner game. It requires the player to run and cover distance with navigation control of upwards, downwards, leftwards and rightwards, while collecting other in-game rewards and avoiding in-game obstacles. The total milestone covered/scores achieved in each planet of the Game is cumulated when Participants create their own login account by entering their name and mobile number, submit their scores and save their progress in the same account. A day for the requirement of the Contest is 00:00 hours to 23:59 hours of a particular day during the Contest Period. g) On any particular day during the Contest Period, Participants can play one planet of the Game and submit their scores only upto 15 times either through the two individual links to the said planet of the Game or through the QR Codes provided on the Rs. 5 and Rs. 10 Promotional Packs. Participants would become ineligibile to receive any prize(s) if they play any planet of the Game and submit their scores more than 15 times per day. h) Once the 15 limits of the day for any planet of the Game are exhausted through the Rs. 5 & Rs. 10 Promotional Packs or through the Game links, Participants will have to scan the QR Code on the Promotional Packs or play the Game through the links the next day to continue playing the Game. i) The name entered by the Participants to save their progress made in the Game cannot be sexually explicit or suggestive, violent or derogatory of any ethnic, racial, gender, religious, professional or age group, profane or pornographic in any manner whatsoever. Failure to abide by this rule will result in disqualification from the Contest. j) Participants will have to provide their address when contacted in case they are declared a winner. k) A Participant can enter the Contest from a mobile/tablet or any device through which a QR Code can be scanned and through which the internet can be accessed. The chance to win a prize will come to an end once the 20 Participants as mentioned above have been provided their prizes. 16. The first 20 participants (“Winner”) since the beginning of the Contest who play and clear all the milestones in the first 6 planets and achieves a milestone/score of 16,18,47,84,00,000 in the Game will become eligible to receive a Kids Smart Watch as a prize. 17. The prizes cannot be transferred, exchanged or redeemed for cash. 18. The image of the prizes as depicted on the press ads/posters/TVCs, Promotional Packs etc. are for illustrative purposes only and the actual prizes may vary from the depictions made. 19. ITC shall not be liable for any loss or damage of the prize due to Act of God, Governmental action and other Force Majeure circumstances and shall not be liable to pay any compensation whatsoever for such losses. CONTACTING PRIZE WINNERS 20. From the commencement of this Contest, every 30 business days ITC or Corporate Incentive Solutions Pvt. Ltd., an organizer appointed by ITC shall contact each Winner who is eligible to receive a prize in the Game during the preceding 29 business day period. On the 30 th business day, ITC/organizer so appointed will inform the Winner(s) by a phone call at the number entered by the them at the time of playing the Game, on the prizes that are available to be offered to them.. 21. In the event the Winner’s number is busy, unreachable, or he/she does not attend the call, three (3) more attempts will be made to reach out to them. If even on the fourth attempt, the Winner does not attend the call, or is unreachable, their participation in the Contest comes to an end and their entry stands cancelled and they would become ineligible to receive the prize. In such an event, another Winner will be shortlisted by ITC for the prize. 22. The Winners will have to provide a copy of their or their parent(s)/legal guardian’s address proof such as valid passport, voter card, or driver’s license, a copy of which will have to be submitted at the request of ITC, without which the Winners may be disqualified from the Contest. 23. No Prize will be awarded if the information provided by the Participant at the time of entering the Contest is not factually correct. The prize will be handed over to the Winner only after the formalities mentioned herein are fulfilled. 24. The prizes will be given to the Winners post completion of such audit and verification process as deemed fit by ITC. 25. The list of those Winners whose address has been verified shall be published at www.jelimals.in/t&c every 90 business days from the commencement of the Contest. 26. By sharing their/their parent(s)/legal guardian’s personal information with ITC or with Corporate Incentive Solutions Pvt Ltd, the Participants/their parent(s)/legal guardian consent to collection, storing, processing and use of personal information i.e. name, address, mobile phone number by ITC and/or Corporate Incentive Solutions Pvt Ltd, its affiliates, associates, agents, contractors and other third parties. The personal information is being collected by Corporate Incentive Solutions Pvt Ltd and shall be retained by Corporate Incentive Solutions Pvt Ltd. 27. Personal information given by the Participants/ their parent(s)/legal guardians shall be used to deliver prizes and for promotional activities by Corporate Incentive Solutions Pvt Ltd its affiliates, associates, agents, contractors. 28. The Participants/ their parent(s)/legal guardians have an option of not providing the personal information as required under this Contest. The Participants/ their parent(s)/legal guardians also have an option to withdraw their consent in relation to usage of personal information during the Contest. In all such cases, the entry of the Participant shall not be considered and Participant shall not be eligible for the prize. The Participants/ their parent(s)/legal guardians may reach out to support@incentivesolutions.in for such withdrawals. 29. By participating in this Contest, the Participants/their parent(s)/legal guardians acknowledge and consent to transfer and/or disclosure of their personal information by ITC or Corporate Incentive Solutions Pvt Ltd to any third-party for providing services in relation to this Contest. COURIER REQUIREMENTS 30. The prizes will be dispatched to the Winners via courier, whilst carrying the Prize for the Winner; the courier will carry an acknowledgement receipt (POD). 31. The courier shall require the Winner/their parent(s)/legal guardian (as the case maybe) to sign the acknowledgement receipt (POD) as a proof of receipt of the prize, without which the prize will not be handed over to the Winner. 32. The courier shall collect the signed POD, a self-attested Photo ID from the prize Winner. 33. If the Winner or the family member of such prize Winner present at the address does not cooperate as per the requirements mentioned herein with the courier, the prize will not be given to the shortlisted Participant and the prize will stand forfeited. 34. The prize will be given to the authorized family member of the Winner on submission of a proof of letter of authorization from the Winner in favour of the family member (in the event the Winner is not available at the designated address). 35. If the Winner is not available at the given address, the courier will make 2 more attempts to collect the documents and deliver the prize. If still unsuccessful, the courier shall make no further attempts to deliver the prize. In such an event, the Winner will be informed of the place from where the prize is to be picked up at their own expense. If the Participant fails to pick up the prize from the designated place within a week of informing him / her, the prize will not be given to such Winner and the prize will stand forfeited. 36. If the address is unserviceable, then the shortlisted Participant/any person authorized on their behalf will be required to travel to the nearest courier hub at their expense to collect the prize. 37. ITC shall not be liable for non-receipt of the prize due to incorrect details provided by the Winner. PUBLICITY 38. The Participant undertakes and irrevocably and unconditionally permits ITC to cover the Contest through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard. 39. At the request of ITC, Participants shall participate in all activities relating to the Contest surrounding the winning of the Prize, free of charge including participating in any photography/videography session, interviews etc., and they consent to ITC using their name and image in promotional material. TERMS & CONDITIONS FOR THE PRIZE 40. The prize Winner shall follow the instructions given by or on behalf of the Organizer, when a call is made to him/her by or on behalf of the Organizer informing him/her in the event of his/her selection as the prize Winner. 41. Award of Prize is subject to the verification of documents such as government Photo-ID proof such as valid Indian passport /residence proof/ Driver’s license PAN card and/or such other documents as may be requested and submitted by the prize Winner. After verification the prize Winner will be informed about the entire process of redemption of the Prize. GENERAL CONDITIONS 42. The decision of ITC or the Agency, as regards the selection of Winners and distribution of the prizes shall be final, subject only to ITC’s approval. No correspondence or any other claims whatsoever, in this regard will be entertained. 43. ITC reserves the right to change, defer, alter or cancel this Contest in part or full, or change any or all of the terms and conditions that are applicable, without giving prior intimation/notice of any kind and will not be liable for any consequential losses/damages. Any decision of ITC in this regard and in general with respect to this Contest and the terms and conditions thereto shall be final, binding and non-contestable. 44. The decision of ITC shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or agency between any Participant and ITC and the Participant shall not have the authority to bind ITC in any manner whatsoever. 45. Neither ITC nor its agency shall be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Contest due to any government restrictions. 46. Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of ITC or its Agency. 47. ITC or its agency accepts no responsibility for loss of internet connectivity, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. ITC or it’s agency shall not be liable for any consequences of user error including (without limitation) costs incurred. RELEASE AND LIMITATIONS OF LIABILITY 48. ITC shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained or any costs incurred, as a result of acceptance of any Prize. 49. By entering the Contest, the Participant hereby releases from and agrees to indemnify ITC and/ or any of its respective officers/employees from and against all liability, cost, loss or expense arising out of acceptance of the prize or participation in the Contest including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise. 50. ITC accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself, or third parties in relation to the prizes. DISPUTES 51. The courts of competent jurisdiction at Bengaluru shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with the Contest. 52. Further all issues and questions concerning the construction, validity, interpretation and enforceability of these terms and conditions, or the rights and obligations of the Participants and/or ITC and/or Partners of this Contest, shall be governed and construed in accordance with the laws of India.
